Abstract

The Water Code of the Republic of Belarus, along with positive aspects, such as requirements for the improvement of surface water bodies, the establishment of the ecological status of a water body, the creation of basin councils for the management of water bodies, contains a number of gaps and conflicts, in particular, there are no definitions of water and water stock, no distinction has been made between waters that are the object of natural resource law and water related to property – the object of civil law, the methods of water use are not specified and the types of water use are incorrectly defined, there is no definition of the water body as real estate, the width of the bank is not specified, the list of parts of water bodies and their definitions are not formulated, the forms of water use are controversially fixed, which does not contribute to the streamlining of activities in the field of water use. The present work is devoted to eliminating these shortcomings.
